Terms and Conditions

These are the Terms & Conditions associated with the purchase contract that you enter into with The Granary Gallery, The Granary, 3 Oakhay Court, Stoke Canon, Devon EX5 4ED when you buy through our website.

1. An order for goods placed by you through our website shall be subject to these terms and conditions.

2. All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

3. Nothing stated or implied in these terms and conditions shall affect the statutory rights of any customer.

ORDERS

4. We undertake to supply artworks as described on these web pages.

5. All orders for goods shall be deemed to be an offer by you to purchase goods pursuant to these terms and conditions. 

6. Upon placing an order we will send an acknowledgement to you. Acceptance of your order and completion of our contract will not take place until despatch of the goods to you.

7. We do not file details of your order for your subsequent access on this website so please print these terms and conditions and our order acknowledgement for your records.

PRICING

8. All goods offered for sale through our website are priced in Pounds Sterling (£) and are not subject to VAT.

9. We reserve the right to notify you at any time prior to delivery of any price errors. If you receive such a notification we will not despatch the goods unless you confirm that you still wish to proceed with the purchase.

PAYMENT

10. By placing an order you consent to payment being charged to your credit or debit card account.

11. We accept the following credit/debit card payments: VISA credit, Mastercard, Electron, Maestro/Switch, Visa Debit and Solo.

12. Upon payment, we will send you a receipt via email.

DELIVERY

13. The goods will be delivered to you at the address provided by you under shipping address.

14. We aim to deliver goods to you within a maximum of 10 working days, but where possible within 5.

15. If you have not received the item(s) within 10 days of placing the order please advise us so that we may trace the parcel.

16. All delivery charges are included within to your purchase.

17. The risk in the goods shall pass to you upon signed delivery.

RETURNS

18. Everything sold by The Granary Gallery has been carefully checked. Sometimes, however, items are damaged, defective or are unacceptable in some other way and we will make every effort to rectify that situation.

THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS IN ANY WAY

19. When you receive your artworks, please check them immediately. Any damage must be notified to The Granary Gallery within 3 days of delivery via email with photos showing any damage. You have the option of choosing an alternative or a full refund.

20. Under the Distance Selling Regulations, you have a right to return any artwork purchased on this website for a full refund. This does not apply to artworks personalised or made to your specification, such as commissioned works. To return your artwork, e-mail us at info@thegranarygallery.co.uk or write to us at the address at the top of this section within seven days of delivery. You must then return the goods to us at, The Granary Gallery to the address set out at the beginning of these terms and conditions, at your cost. You must ensure that the goods are packed securely - artworks that are deemed to have been damaged on return to us may not warrant a full refund.

YOUR WARRANTY

21. You, the buyer, warrant that all the details provided on the order form for the purpose of purchasing the goods are correct, that the credit card you are using is your own and that there are sufficient funds and/or sufficient unused limit available to cover the cost of the goods.

22. The details you supply (not including credit card details) will be stored on computer and used by us to provide details of future events; newsletters and other information relating to the sale of our art products. If you do not wish to receive this information please tick the box on your order form or advise us in writing and we will remove your details from our database.

SECURITY

23. Your security and privacy are our priority - for full details please view our Privacy Policy online.

24. We only accept your personal information such as address and telephone numbers for our own purposes. Your payment details are captured by a secure server off-site.

25. Security is an issue which concerns all Internet shoppers. No client information is held in an insecure manner and all information is safely held in a secure server provided by our specialist Internet Service Provider.

26. All information gathered, including any information given at the time of ordering is collected lawfully and in accordance with the Data Protection Act 1998. The information collected about you will be used firstly to enable us to process your order or your enquiry and second, to provide you with the best possible customer service. The information we hold will be accurate and up-to-date and will be held in accordance with the law. INTELLECTUAL PROPERTY RIGHTS

27. Our artists retain copyright and intellectual property rights on any of their artworks sold and their artworks cannot be reproduced in any format without the artists consent. The copyright of any images or material contained in this website and any trademarks and brands included in that material belongs to The Granary Gallery or our artists.

WEBSITE

28. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

29. We will attempt to ensure that the information available on the website at any time is accurate. However, we will not be held liable for any errors or omissions. We will use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of these.

30. Whilst we attempt to be as accurate as possible with the specifications of the artwork offered for sale, we cannot be held responsible for any inaccuracies.

QUERIES & COMPLAINTS

31. Should you have any complaints about our products or services, we would request that these be put in writing and e-mailed to info@thegranarygallery.co.uk.

32. Any complaint received will be acknowledged within five working days and you will be informed of a projected time scale for dealing with that complaint, together with the steps we intend to take in dealing with it.

OTHER

33. You may not assign or sub-contract any of your rights or obligations under these terms and conditions.

34. If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

35. These terms and conditions do not create or confer any rights or benefits enforceable by any person that is not a party (within the meaning of the U.K. Contracts (Rights of Third Parties) Act 1999).

36. No delay or failure by us to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of ours.

37. These terms and conditions supersede all prior representations understandings and agreements between you and us relating to the use of this website and sets out the entire agreement and understanding between you and us for your use of this website

38. These terms and conditions are governed by English law and are subject to the exclusive jurisdiction of the English Courts.
